Vocabulary Terms and Diction

1. “We”, “Us”, “Our”, “Mods”, “Admins”, and “Staff” refer to the moderators, admin team, staff team, and owner of the Realm of Elune.
2. “You”, “Member”, and “User” refer to yourself, and the members of the server/community.
3. “The server”, “The Community” and “RoE” refer to The Realm of Elune and its properties. (The Realm of Elune discord server, the toyhou.se account, the Instagram account, Carrd, etc.)

1.2 General Rules

1. Characters and Art affiliated with RoE may not be used for commercial or for-profit purposes unless priorly discussed with an appropriate staff member.
2. If trading or reselling a RoE character, you may not resell the character for more than you originally purchased or received them for, unless additional value has been added. More information on character value can be found in section 4.2
3. A Toyhou.se account is required to own any RoE designs.
4. AI and/or Machine Learning is not to be used in any way with any works produced by staff or the community.
5. 18+ or any adult content is not permitted by any means within RoE. Any Masterlisted characters may not be drawn, depicted, or represented in any suggestive, sexual, or inappropriate way. More information in section 2.0

Community Conduct

2.0 PG-13 and NSFW

1. Anyone over the age of 13 is welcome to join RoE. Those under 13 may not participate. Falsifying this information in order to gain access will result in an immediate ban.
2. RoE is a PG-13 Community and all artworks, written and visual, must follow those guidelines. Any works depicting extreme violence, sexual themes, illegal activity, offensive behavior, or anything else along those lines will not be tolerated. If you are unsure if a topic or theme will be deemed inappropriate, open a staff help ticket to ask before posting or use your best judgment. If you are unsure if it falls into the rules of being SFW (Safe For Work), then it most likely should not be posted.
3. Warnings or immediate bans may be issued to those who bring these themes or topics into the community, whether through works of art (written or visual), in conversation, or in any other form.
4. All RoE characters must remain SFW at all times, and any artworks (written or visual) must be SFW. If any NSFW art or content is found affiliated with any RoE character, it will be immediately voided from the species. More information on Voiding in section 5.1

2.1 Community Guidelines

1. Please be respectful to all staff and all community members. We reserve the right to warn or ban members for bad, inappropriate, or rude behavior towards anyone within the community. This includes, but is not limited to, listening and following redirections given by mods or admins, being mindful of others feelings/opinions, refraining from argumentative behaviors, participating in inappropriate or harmful behaviors, disrespecting mods or other members of staff for decisions, etc.
2. Reading and agreeing to our rules is a requirement before joining The Realm of Elune discord server. By joining the community, you agree to follow those rules.
3. If you see an issue within the community, do not minimod. Direct all concerns to staff. Help Tickets may be opened at any time regarding any questions or concerns you may have.
4. Games and Quests within the RoE server each have their own sets of rules and guidelines you must follow in order to participate. Breaking the rules may result in a warning. Repeated warnings may result in a permanent ban from participating in Games and Quests.
5. Conversation topics deemed NSFW (Not Safe For Work) or inappropriate for users under the age of 13 should be avoided. Any racist, homophobic, transphobic, or sexist, is strictly prohibited and may result in a ban. NSFW topics may include but are not limited to, heavy gore, violence, sexual content, etc.
6. Spam and other intentionally annoying behavior is not permitted. This includes but is not limited to, ghost pings, walls of text, repeated copy and pastes, etc.

2.2 Content Sharing

1. NSFW is strictly prohibited. Any content shared within any RoE space must be PG-13 and SFW. This includes, but is not limited to, character profiles, personal profiles, video and other media links, etc.
2. All art shared within the server must be appropriately credited.
3. Plagiarized content is strictly prohibited in all forms. This includes, but is not limited to, tracing, design theft, classic plagiarism, etc. and extends to all staff and members of the community. Any staff or member of the community found to be guilty of plagiarism may receive a warning or ban, depending on severity. Plagiarized designs may be revoked/voided. Plagiarized event submissions may be disqualified.

2.3 Drama and Gossip

1. RoE will not tolerate drama or gossip within the community.
2. Callout posts and name-dropping are not allowed and will be immediately removed. Posts and comments like these may result in a warning.
3. Guilt-tripping, harassment, or any derogatory comments towards staff or other members of the community will not be tolerated and may result in a warning or ban depending on severity.

2.4 Arguments and Disputes

1. Any arguments or disputes should immediately be brought to a Moderator or Admin’s attention either by ping or through a staff ticket. If you have a problem with another member, please open a general help ticket. If you have a problem with a staff member, please contact Aurora (Mothsteria) directly.
2. Do not engage in any behavior that would intentionally aggravate or instigate staff or other members of the community. This also includes inserting yourself into any arguments or disagreements that may be currently happening. Our mods and admins are there to mediate and de-escalate, please let them do their jobs.
3. Falsifying information regarding a staff member or another member of the community for your own gain will not be tolerated, and may result in a warning or immediate ban. This includes, but is not limited to, photoshopping conversations, making false claims about another member, withholding important or relevant information, etc.

2.5 Violations and Infractions

1. By agreeing to The Realm of Elune Terms of Service, you are acknowledging that you will be held accountable for your actions, and that punishments will be distributed accordingly if you breach our ToS
2. Members who receive a warning will be notified by DM (Direct Message) through ProBot. All details regarding the warning will be provided in the DM. If you have any further questions or concerns, you are free to open a general staff ticket.
3. Warnings can and will not be removed from your account within RoE for any reason, unless solid proof can be provided that the warning was given by mistake or without proper context.
4. After three (3) warnings, your account with the RoE will be suspended for one (1) month. If you receive another warning for any reason after a suspension, you will be banned from the RoE. Bans are permanent and cannot be negotiated for any reason. Any alternate (“alt”) accounts created to get around this ban will be immediately banned as well.
5. If you truly feel your ban was unjust or unfair, you may appeal your ban with Aurora (Mothsteria) after three (3) months. You must provide proof and context as to why you feel you were unfairly banned. Staff is in no way required or obligated to lift your ban. If your ban is not lifted, no more appeals may be made.

Artwork and Ownership

3.0 Species Ownership

1. Kulpera, and any other species within The Realm of Elune are owned specifically by Aurora (Mothsteria). Normal Members may not create a Kulpera without an appropriate MYO (Make Your Own) Ticket, as this species is semi-closed. Being a Semi-Closed Species means that only Aurora (Mothsteria) and her staff may create characters and designs under the name “Kulpera”. If you do not own an appropriate MYO Ticket you may not make a character under the species name. All types of MYO Tickets are obtainable for free with species currency, making the species semi-closed.
2. Individual characters created by a legal/appropriate MYO Ticket or purchased from a staff member may be owned by members, and will belong strictly to said persons. Characters may not be used for commercial purposes unless priorly discussed with the original artist and Aurora (Mothsteria).
3. Ownership of a RoE character design includes partial rights to the design. Individual artists ToS may still apply.
4. Ownership of a RoE character design includes full rights to the characters details and backstory. However, when participating in the RoE server, community, and events, backstories and character details must fit within RoE lore.

3.1 Species Assets

1. All assets are owned by Aurora (Mothsteria) and The Realm of Elune. This includes, but is not limited to, all non-member submitted art, templates, bases, icons, emotes, NPCs, and species.
2. By joining the RoE staff team, you are agreeing that any assets created specifically for the RoE will be owned by Aurora (Mothsteria) and The RoE, and can not be separated from The RoE.
3. Reproduction of any assets for commercial use is strictly prohibited and will be dealt with legally if necessary.
4. Members may not create unofficial RoE assets with the intent to profit. This includes, but is not limited to, bases, templates, icons, emotes, etc.
5. RoE does not claim ownership of assets submitted by members of the community, unless otherwise stated prior to having members submit works. We do ask for non-exclusive, royalty-free permission to use created work with proper credit if any member submitted assets are used for decoration, advertising, etc. Members will be notified any time their asset is used.

3.2 Copyright

1. We do not claim ownership or the concept of fox/wolf/deer hybrid type creatures. However, The Realm of Elune, Kulpera, and all other names or species within it, are the intellectual property of Aurora (Mothsteria) and cannot be used if it does not follow the rules stated within this ToS.
2. We retain rights to all original artworks. Members may not claim it as their own for anything other than personal use, unless priorly discussed with the original artist and Aurora (Mothsteria).
3. All commissioned artwork within RoE is for non-commercial use. Any RoE associated works may not be used for commercial purposes or for profit.
4. When reposting RoE artwork or content, all proper credit must be given, and all watermarks (RoE, and/or Original Artist) must remain unaltered and intact.
5. Things that may lead to warnings or an immediate ban include, but are not limited to, claiming any staff RoE artwork as your own, altering any official RoE artwork in any way without explicit permission (aside from cropping and resizing unless to solely remove watermarks or signatures), using RoE artworks for AI or Machine Learning in any way, redistributing RoE artworks as your own, etc.

3.3 Character Ownership

1. When purchasing a RoE character, you must possess a toyhou.se account. All links must remain attached to the character, or the character may be voided. For more information on voiding, see section 5.1
2. Original creator credits must remain on the toyhou.se character profile. Removal of these credits may result in a warning or ban.
3. RoE characters may be used for personal use, such as official RoE Quest, Games, Events, personal art, writing, role-playing, making or buying personal merchandise for yourself, or other related uses.
4. RoE characters may not be used for commercial use in any way without explicit permission from the original artist and Aurora (Mothsteria). Commercial Use is defined as: “the monetization of a product, intellectual property, service, or media”.

3.4 Character Artworks

1. All artworks depicting RoE characters must remain SFW. Any users found violating this rule will be warned or potentially banned depending on the severity. Characters with NSFW works associated with them may be voided. For more information on voiding, see section 5.1

3. All artwork created by members of RoE characters belongs to the respective owner, and can be used in any non-commercial way. This includes, but is not limited to, personal portfolios, icons, profile pictures, personal prints, personal merchandise, etc. as long as it also follows the original artists ToS, and proper credit is given.

Designs, Sales and Trades

4.0 Character Designs

1. In order to create a Kulpera, you need the appropriate MYO Ticket, or explicit permission from Aurora (Mothsteria).
2. Other RoE species have different criteria in order to create them and are subject to change.
3. You are given one (1) Uncommon MYO upon joining The Realm of Elune Discord server for the first time to create your first Kulpera. You may also purchase MYO Tickets with Species Currency, obtain them through level up within the Discord server, earn them through contests, giveaways and events, etc.
4. Unofficial design concepts may not be sold as adopts or advertised as Kulpera, even if it is disclosed that they are not official.
5. If you are not a member of staff, you may not advertise custom RoE customs or commissions. This means you may not advertise that you will design someone’s MYO for them. Others may advertise that they are looking for someone to design their MYO for them, as long as they have the required items.
6. RoE characters may be created from pre-existing designs, as long as you have explicit permission from the original designer. You may not create RoE characters from copyrighted characters, including, but not limited to, cartoons, comics, games, movies, etc. This is in violation of our rule against plagiarism (section 2.2.3), and would be considered theft. Inspiration is allowed with proper credit, but design approval will ultimately be up to staff discretion.
7. All RoE designs must remain SFW. Any designs deemed NSFW will not be approved or affiliated with RoE.
8. Any RoE character re-designs require specific items that can be purchased with species currency. All re-designs must still follow the original artists ToS, along with the RoE ToS, and be submitted through the appropriate channels within the Discord server. Re-designs that render a RoE character unrecognizable are not allowed.
9. RoE designs will never be revoked from members except for certain circumstances. This includes breaking certain ToS that would result in a void from the species, for more information on voiding, see section 5.1, or if a payment to a staff member falls through.

4.1 Character Sales and Trades

1. Official RoE character sales are held within The Realm of Elune Discord or on the KulperaSpecies Instagram account only. If you suspect a scam, please contact a RoE staff member immediately.
2. Purchasing a RoE character or design is done at the discretion and risk of the buyer. We are not responsible for the reimbursement in the case of user based scams or breaking of the ToS by a third party. Please check that any RoE character you purchase from another member has a link back to our Masterlist toyhou.se account. This link is required for any transactions between members.
3. Trading a character for anything other than real world currency is up to buyer and seller discretion. Please use your best judgment when completing trades with other members.
4. You may not delete any art after someone has agreed to purchase a RoE character from you, if they expect to receive all works shown in their toyhou.se profile. This may result in a warning or ban, depending on severity.
5. Backing out of sales or trades is highly frowned upon within the RoE community, and while we cannot control what happens between member sales or trades, backing out of sales or trades between staff and members may result in warnings or bans, depending on number of offenses and severity. This goes both ways for staff and members.

4.2 Character Value

1. The base value of RoE characters is documented upon Masterlist creation. Please ensure you are not overpaying for a character when purchasing a RoE character from another member.
2. The base value of a RoE character is what that character was originally obtained for. If purchased as an adopt or custom, the value will be what you paid for it. This can be real world currency, species currency, art, etc.
3. RoE character Base Value within the Masterlist will not be updated. However, this does not necessarily reflect the total or current value of the character. Refer to the personal profile linked to the Masterlist profile and the Transfer Logs to see previous transactions and current art for individual character’s worth.
4. RoE characters may not be sold for more than they were obtained or purchased for, unless more value has been added. A MYO’s base value is $0, unless purchased with species currency. Then, the value would be in species currency, and the character could only be sold in species currency if no additional value has been added. A MYO has no real world monetary value unless additional value has been added.
5. Value is defined as any works of art, written, visual or otherwise, that has been purchased or personally created specifically of the RoE character. Art trades may count towards character value if both sides put in time and effort into pieces for each other. The value of that piece is then determined by the parties in the trade. Gift art (where only one party creates art, and receives nothing in return), does not add monetary value to a RoE character. Personal art done of your own RoE character adds value to those RoE characters.

4.3 Species Currency and Items

1. Species currency may not be purchased or sold for real world currency, or any form of monetary currency or voucher. This includes, but is not limited to, dA Points, Discord Nitro, other premium game currencies, etc.
2. Moonshards relative value is $1 USD, however they may never be purchased or sold for real world currency. This is to maintain a relatively stable economy for RoE.
3. You may trade your species currency for RoE items, art, or any non-RoE related things that do not involve a monetary purchase.
